Terms of service
This is a translation for convenience. If it differs from the Chinese version, the Chinese version governs.
Please read these terms carefully, especially the provisions in bold that exclude or limit our liability or limit your rights, and the dispute resolution provision. By signing in to or using the Service, you confirm that you have read and agree to these terms and the Privacy policy. If you don't agree, don't use the Service.
1. About these terms
These terms are an agreement between you and the operator of still.fail (an individual developer based in mainland China, “we”) about using the still.fail hosted service. The hosted service includes the still.fail website, the web app (app.still.fail), public share pages, preview pages, relay servers, and the desktop and Android apps when they connect to these services (together, the “Service”). These terms also apply to the beta channel youdid.wtf.
You must be at least 16 years old to use the Service. If you use it on behalf of a company or other organization, you represent that you are authorized to accept these terms on its behalf.
2. What the Service is
still.fail lets you direct AI coding agents (such as Claude Code and Codex) running on your own machines from a chat. Agents run on stations installed by you or members of your workspace; the Service handles sign-in, workspace management, connections and relaying between devices and stations, push notifications and so on.
The Service is currently free. The free plan has usage limits (for example, on the number of workspaces, members and stations); the standard plan is available with an invite code or when we enable it for you. We may change limits and plans. If we start charging in the future, we will tell you in advance and agree separate payment terms with you; we won't charge you without your knowledge.
3. Accounts
- You can sign in with a Google account or an email verification code. Please use a real, valid email address;
- You are responsible for activity on your account, devices and stations. Keep the devices you sign in on secure; if you find someone else using your account, sign out of all devices promptly and let us know;
- Don't sell, rent or transfer your account, and don't impersonate anyone.
4. Your stations and agents
Agents on a station run commands, read and write files, and access the network and any accounts you've configured, with the permissions of the corresponding system account on that machine. Agents can make mistakes: they may delete or wrongly change files, or do things you didn't want. You need to:
- Run stations on machines and system accounts you trust, use a dedicated account or machine where appropriate, and keep backups;
- Add only people you trust to a workspace. Workspace membership is access within the app, not isolation at the operating-system level;
- Check the agents' work, and take responsibility for what you run on your stations, the actions agents take on your behalf, and their consequences;
- Follow the terms of third-party services you use on your stations (such as Anthropic, OpenAI, GitHub and Slack), including their limits on how subscription accounts may be used.
We don't control or review agent output, and we don't guarantee that agent output is correct, complete, safe or fit for your purposes.
5. Your content
Content you enter or upload in the Service, or have agents generate (“your content”), belongs to you or its original rights holders. Your content is stored on your stations; our servers don't store chat content (for the exceptions, see section 3 of the Privacy policy). You grant us the limited processing rights needed to provide the Service, such as forwarding push notifications and storing issue reports you submit.
Anyone with the link can view a chat you share publicly. Before sharing, make sure it contains nothing you don't want made public; you can revoke a share at any time. You represent that your content doesn't infringe anyone's rights or break the law.
6. Prohibited conduct
When using the Service, you must not:
- Violate the laws and regulations of the People's Republic of China or the laws where you are, or create or spread illegal content;
- Infringe others' intellectual property, privacy or other lawful rights and interests;
- Access other people's accounts, stations, devices or data without authorization, or attack, scan or penetration-test any system (except security research with explicit authorization);
- Spread malware, send spam or commit fraud;
- Use the relay servers as a general-purpose proxy or a tool for getting around network blocks, or otherwise abuse the relay;
- Circumvent usage limits, rate limits or bans, or register accounts in bulk by automated means;
- Interfere with or disrupt the normal operation of the Service, or place an unreasonable load on it.
7. Open-source license and trademarks
still.fail's code is open source under the MIT License. These terms don't limit the rights you have in the code under the MIT License. But the MIT License doesn't cover the still.fail names and logos; the rules for using them are in the Trademark policy.
8. Third-party services
The Service relies on or connects to third-party services, such as Google sign-in, Cloudflare and push services, as well as Claude, Codex, Slack, GitHub and others that you use on your stations. Each of these services is the responsibility of its provider and is governed by its own terms. We are not liable for the availability of third-party services, for changes to them, or for losses they cause.
9. Changes, suspension and termination
- We may improve, modify, suspend or discontinue all or part of the Service at any time. We'll try to give advance notice of changes that significantly affect you;
- If you breach these terms or the law, or your use puts the Service, other users or third parties at risk, we may restrict or ban your account and delete the related workspaces or public shares, without prior notice;
- You may stop using the Service at any time. To delete your account, follow section 10 of the Privacy policy;
- If the Service shuts down, we'll announce it in advance. Because chat content and files are stored on your stations, shutting down won't delete them.
10. Disclaimer
The Service is provided “as is” and “as available”. To the extent permitted by law, we make no express or implied warranties, including any warranty that the Service will be uninterrupted, timely, secure or error-free, or fit for your particular purpose. The Service is run by an individual developer and may be interrupted by maintenance, failures, network problems, third-party services or force majeure. Don't make the Service the only thing critical work depends on, and back up important data yourself.
11. Limitation of liability
To the maximum extent permitted by law: (1) we are not liable for indirect losses, lost profits or lost data arising from use of or inability to use the Service, agent output or actions, third-party services, or unauthorized access by others to your account, stations or data; (2) our total liability to you is limited to the fees you actually paid for the Service in the 12 months before the event giving rise to the liability, or RMB 100 if you haven't paid anything.
These limits don't apply to liability that by law cannot be excluded or limited, including liability for property loss caused to you by our intentional misconduct or gross negligence, and liability for personal injury.
12. Indemnity
If a third party makes a claim against us because of your breach of these terms or the law, your content, or what you do through your stations and agents, you will compensate us for the resulting losses, including reasonable legal fees.
13. Changes to these terms
We may change these terms. Changes will be posted on this page with an updated effective date. We'll tell you about material changes before they take effect, through an in-app notice or by email. If you keep using the Service after the changes take effect, you agree to the revised terms; if you don't agree, stop using the Service.
14. Governing law and disputes
These terms are governed by the laws of the People's Republic of China, excluding for this purpose the laws of Hong Kong SAR, Macao SAR and Taiwan. The parties will first try to resolve any dispute arising from these terms or the Service through friendly negotiation; if negotiation fails, either party may bring a lawsuit in a competent people's court in Changsha, Hunan Province.
15. Miscellaneous
- If any provision of these terms is found invalid or unenforceable, the other provisions remain in effect;
- Our not exercising a right does not mean we waive it;
- These terms are available in Chinese and English. If the two differ, the Chinese version governs.
